Please read the Terms and Conditions of use for the electronic app Secondhand Souq carefully. If you do not agree to these Terms and Conditions, please do not continue using the app. Your continued use of the app constitutes your acceptance of these Terms and Conditions:

Definitions:

• "User" refers to a user of the Secondhand Souq app for buying or selling goods, including all related expressions.
• "Company" means Dar Hessa Company, the operator of the app.
• "User Information" means the personal details you provide us through the Secondhand Souq website and app.
• "Content" means any reviews, comments, messages, data, information, text, music, audio, images, drawings, videos, codes, or other materials broadcast to or displayed on the app directly or through third-party websites or applications.
• "Interactive Areas" means discussion forums, message boards, review services, chats, or other forums provided by the Secondhand Souq app used by users to post content.
• "Automated Processing" refers to any robot, spider, screen scraper, data aggregation tools, or other automated tools or routines.
• "Listing": any post or offer to sell used goods via the Secondhand Souq website and app.
• "Item": any used product displayed via the Secondhand Souq website and app.
• "Transaction": the exchange between the seller and buyer for the listed item.

Terms and Conditions

By using the Secondhand Souq app, you agree to these Terms and Conditions. If you do not agree, you must stop using the website and app. We reserve the right to change the Terms and Conditions from time to time. You are expected to review them periodically. We are not obliged to contact or inform you of changes, and continued use of the app constitutes acceptance of the updated terms.

As part of our commitment to making the Secondhand Souq app a platform you want to keep visiting, we welcome all your comments on any policies or rules we list below.

User Obligations

The user acknowledges and agrees to use the website/app and its services according to the applicable terms and laws.

• The user must be at least twenty-one (21) years old.
• If the user is under 21, they must have parental or guardian consent.
• The user declares and acknowledges their legal right and eligibility to use the Secondhand Souq platform.
• The platform may require documentation to verify the user's identity or ownership of the listed item, and the account may be temporarily suspended until verification is complete.
• The user agrees not to copy, download, reproduce, republish, frame, broadcast, or transmit any materials provided on the Secondhand Souq website/app except for personal use.
• The user must comply with rules for any promotions and must not interfere with the operation or security of the platform or cause harm or disruption to other users or employees.
• The user must not be a competitor or provide a similar product or service to Dar Hessa.
• The user and service provider must comply with all applicable laws and regulations in the country of service.
• The user must provide accurate information and comply with any notices related to services provided (sales or purchases) to avoid disruption of operational processes by Secondhand Souq
• Users must not use the app in any way that causes harm, annoyance, or harassment.
• Users must keep their login details and account information secure.
• Users must submit all documents that prove their identity or item ownership as requested by Secondhand Souq.
• Dar Hessa reserves the right to refuse service or app access without providing reasons.
• Users may not cancel any service (sale or purchase) after 3 minutes of confirmation. If canceled after being requested, a penalty fee of ……………. will be charged.
• To use the Secondhand Souq platform, you need internet access. You are responsible for all related fees and for providing the required equipment to enable you to connect to the internet and modem and other necessary devices for access due to the limited capacity of all server devices and their usage by people at the same time.
• Users must commit to not using the side and application in any form or way that lead to damage or overload our servers or networks and that in accordance with all applicable laws.
• Users must not (whether personally or through a third party):
  • Use automated tools to monitor, copy, or extract pages or data without prior written permission.
  • Use automated process to collect or gather information, consent or data accessible through the app with third-party data, material and information.
  • Interfere with the proper functioning of the platform using automated methods.
• Using the name you provided in connection with the content, Users grant us the right to legally act against any violation of their or our rights in submitted content. All submitted content is considered non-confidential and non-proprietary and you agree to submitted all required documents to enable us to benefit from the rights granted to us, as needed.
• The company is not obligated to use any content or pay any financial compensation for this use.
• Users are prohibited from posting or uploading any content that is illegal, defamatory, slanderous, offensive to any religion or ethnic group, obscene, pornographic, indecent, vulgar, harassing,, threatening, in violation of privacy or publishing rights, violent, sensitive, fraudulent, or otherwise unacceptable in any form.
• It is strictly prohibited to list or sell the following items:
  • Weapons and ammunition
  • Narcotics or psychotropic substances
  • Official documents or personal IDs
  • Counterfeit or intellectual property-infringing goods
  • Pornographic or indecent materials
  • Banned medicines or prescription-required drugs
  • Any prohibited item under Kuwaiti law
• Sellers must not:
  • Post misleading or fraudulent ads
  • Use the platform commercially without required licenses
• Sellers must:
  • Be the legal owner or authorized to sell
  • Accurately describe items and disclose defects
  • Remove listings after selling
  • Avoid listing any item that violates laws, IP, or ethics
• The company acts as a platform provider and does not own or guarantee any item. All items are sold "as is" unless otherwise stated by the seller. Buyers are solely responsible for inspection.
• The platform is not responsible for dispute resolution but may investigate complaints and suspend violators in its own discretion.
• The company reserves the right to remove any listing or suspend user accounts.
• Users must comply with all applicable local laws for sales, taxes, and product safety.
• Stolen, fake, or illegal items are strictly prohibited.
• Termination: We reserve the right to immediately terminate your access to the Secondhand Souq platform if you breach these terms or engage in any behavior deemed unacceptable by us in our sole discretion.

• Liability: The company is not responsible for product quality, delivery, or payment issues.
• The user acknowledges that the Secondhand Souq is a tech platform facilitating used item sales and purchases and is not a party to any transactions. The user agrees to indemnify the company and its staff for any claims, losses, or costs (including legal fees) arising from their use of the app or breach of these terms.
• Privacy Policy: We respect your privacy and commit to protecting your data. User information is collected solely to provide and improve our services. We do not share your data without consent unless legally required. You are responsible for keeping your login credentials confidential.
• Governing Law and Jurisdiction: These terms are governed by the laws and regulations of the State of Kuwait, under the supervision of the Ministry of Commerce and Industry and fall under the exclusive jurisdiction of the Kuwaiti courts.
